Own a home in Spain? You still pay tax here.
Even if you don't rent it out, owning a property in Spain as a non-resident means filing a Spanish tax return every year. We file your form 210 for you, in English, so you never get a surprise letter from the tax office.
What you need to file, and when.
Your home is not rented
Spain taxes an imputed income: 1.1% or 2% of the property's cadastral value, depending on when it was last revised. You file it the year after, and the rate is 19% for EU/EEA residents and 24% for everyone else.
You rent it out
Rental income is taxed at 19% (EU/EEA residents, who can deduct related expenses) or 24% (rest of the world, on the gross income). The months it isn't rented still count as imputed income.
You sell it
The buyer withholds 3% of the price and pays it to the tax office. You then declare the capital gain at 19% and, if the withholding was higher than the tax due, we claim the difference back for you.
We take care of it every year
- Calculate and file your form 210 for each owner and each property.
- Deduct allowable expenses if you live in the EU/EEA and rent it out.
- Apply your country's double tax treaty.
- Handle the sale: capital gain, 3% withholding (form 211) and refunds.
- Answer letters from the Spanish tax office on your behalf.
- Remind you every year, in English, before the deadline.
Common mistakes we fix
Not filing the imputed income because "the house isn't rented". Deducting expenses when you live outside the EU. Forgetting a co-owner: each owner files their own return. Not claiming back the 3% withholding after a sale.
If you've missed past years, we can regularise them for you, usually with lower surcharges than if the tax office finds them first.
